Welcome to boutIt! These Terms of Service ("Terms") are a legal agreement between you and Boutit Inc. ("Boutit," "we," "us," or "our"), These Terms govern your access to and use of the boutIt mobile application, website, and any related services (collectively, the "Service").
By creating an account, accessing, or using boutIt, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. Your continued use of boutIt after any changes to these Terms constitutes your acceptance of those changes.
These Terms include our Privacy Policy, which is incorporated by reference. Please read both documents carefully before using boutIt.
boutIt is intended for users who are at least 18 years of age. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you may not create an account or use boutIt in any way.
We reserve the right to request proof of age at any time and to terminate or suspend accounts where we reasonably believe the user does not meet the age requirement. If we learn that a user under 18 has created an account, we will promptly terminate that account and delete any associated data.
You may not use boutIt if you have been previously banned or removed from the Service, or if you are prohibited from using the Service under applicable law.
To access most features of boutIt, you must create an account. When you create an account, you agree to provide accurate, current, and complete information and to keep this information up to date.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@boutit.live if you suspect any unauthorized use of your account. Boutit Inc. is not liable for any loss or damage arising from your failure to maintain the security of your account.
You may not share your account with others, create multiple accounts, or transfer your account to another person without our prior written consent. We reserve the right to reclaim usernames on behalf of any business or individual that holds legal claim or trademark to those usernames.
boutIt allows you to create, upload, post, share, and store content, including photos, videos, text, and other materials (collectively, "User Content"). This includes posts shared within boutIts, conversations ("convos"), direct messages, and any other content you provide through the Service.
You retain ownership of your User Content. However, by posting or sharing User Content on boutIt, you grant Boutit Inc. a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, reproduce, modify, adapt, distribute, display, and perform your User Content in connection with operating, developing, and improving the Service. This license continues until you delete your User Content or your account, except to the extent your content has been shared with others and they have not deleted it.
You are solely responsible for your User Content. You represent and warrant that: (a) you own your User Content or have the necessary rights and permissions to post it; (b) your User Content does not infringe or violate the intellectual property rights, privacy rights, or any other rights of any third party; and (c) your User Content complies with these Terms and all applicable laws.
We do not endorse any User Content and are not responsible or liable for any User Content posted by users. We reserve the right, but are not obligated, to remove or disable access to any User Content at any time, for any reason, including content that we believe violates these Terms.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, issuing warnings, suspending or terminating accounts, and reporting violations to law enforcement.
The Service, including its design, features, functionality, software, text, images, graphics, logos, and all other content provided by Boutit Inc. (excluding User Content), is owned by or licensed to Boutit Inc. and is protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.
The boutIt name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Boutit Inc. You may not use these marks without our prior written permission.
If you believe that any content on boutIt infringes your intellectual property rights, please contact us at legal@boutit.live with a detailed description of the alleged infringement. We will respond to valid notices in accordance with applicable intellectual property laws.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Boutit Inc. disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Boutit Inc. does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make the Service available are free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information on the Service.
Any content downloaded or otherwise obtained through the use of the Service is accessed at your own risk, and you will be solely responsible for any damage to your device or loss of data that results from the download of any such content.
To the maximum extent permitted by applicable law, in no event shall Boutit Inc., its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your access to or use of (or inability to access or use) the Service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if Boutit Inc. has been advised of the possibility of such damages.
In no event shall the aggregate liability of Boutit Inc. for all claims relating to the Service exceed the greater of one hundred dollars ($100.00 USD) or the amount you paid to Boutit Inc. in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless Boutit Inc. and its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of another party, including intellectual property rights; or (e) your violation of any applicable law or regulation.
We reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of these claims.
You may terminate your account at any time by deleting your account through the boutIt app settings or by contacting us at legal@boutit.live. Upon termination, your right to use the Service will immediately cease.
We may suspend or terminate your account or restrict your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, requests by law enforcement, extended periods of inactivity, or unexpected technical or security issues.
Upon termination, all provisions of these Terms that by their nature should survive will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of the jurisdiction where Boutit Inc. maintains its principal place of business.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Effective Date" at the top of this page. We may also provide additional notice, such as an in-app notification or an email to the address associated with your account.
Your continued use of boutIt after the revised Terms become effective means that you accept and agree to the changes. If you do not agree to the new Terms, you must stop using the Service and delete your account.
